Dear Attorneys, fellow forum members:
My situation is as follows:
I am currently working for a 3rd party Indian consulting firm (Company A). They are in possession of my H-1B visa. I came out of a project on January 29th (2 weeks back). My new project starts on Feb 25th. As I am paid on an hourly basis, I am not paid while I am on bench. As a result I don't have a pay stub for a period of 3 weeks.
Will this be a big problem in the future in terms of Green card processing?
The next question is:
In the time I have been on bench, I was interviewing with other companies as well and now I have a direct full time job offer from Company B (not through any consultant). This is an ideal situation in my opinion as my visa is held directly held with the employer under whom I work. Company B has started the process of filing for my H-1B transfer. It says it will take 8 to 10 days for the transfer to complete. Is this true? Also, can I start working for Company B before my visa is transferred or should I wait for the transfer to complete and keep working on the new project I have with Company A in the meantime (see above)?
I appreciate your help and feedback in this regard, as I don't know much about the legal process.

We have the same notice date - 10/11 but my receipt date is 7/03. And I got my EAD on 10/26. They may be starting a system to process EAD/AP by receipt date. But still...who knows what they are doing it.

Thank you for the reply. I should have been more explicit, the extension of H1 was filed by company B on the basis of company A H1 during transfer , the extension was denied but a new H1 approval notice with company B was given.

If you are questioned on educational equivalence of the 3+2 year degree's parity with US' 4+2 year bachelor + masters, and your education evaluator can make a strong case for it, you should be ok.

Gurus Here is my situation:

2) My 1-140 is pending (Concurrently filed in July 2007) so more than > 180 days
3) Have approved EAD and AP
4) My Current company was a joint version between company A-B . differnt name X
5) Today they decide to split and My job will move to company A by end of this month. Work won�t change..will keep doing what have been doing But now employee of comany A not X
What are my options? I am worried about my GC process..will I loose everything and have to restart the process since I can not evoke my AC21 ..since it�s not approved yet.
Please Advise

I recently started work with a new employer using my EAD. I have a pending RFE on my 485 which I have to respond to in a couple of weeks. However, today I noticed that my 485 got a soft LUD of the day following the day I started with my new employer. My new employer uses eVerify but I didnt expect that it could be linked with a pending 485. Maybe I am wrong but I see no reason for the USCIS to touch my 485 until I have responded to the RFE.
Has anyone else noticed something similar when you started with a new employer using eVerify?
E Verify is a system operated by the social security administration, not the Department of Homeland Security. Cannot imagine your LUD and E verify can be remotely related. Just a coincidence. Relax enjoy your new job and let the I 485 process roll along as it will.

My 6-year H1B expires by end of April 2011 and I am quitting my job by the end of March and changing my status to H4. My I-140 has been approved, I-485 not submitted. Now I only have 1 month left in the 6-year H1B period and am in H4 after March, can I find a new employer to apply for H1B for me, using the 1 month? If yes, can the new employer apply for a 3-year H1B visa?

There is no AC21 for derivative applicants. She can join any employer at any time. AC21 comes into picture only for primary applicant. Derivatives get almost a virtual GC in terms of EAD.

I guess your H4 is not approved yet and continuing your employment on H1B. Your best course of action would be to have your employer file an extension (beyond 6 years) for H1B and get a 3-year approval (with approved I-140). You can change jobs after this but if you don't want to take this path you can still find a new employer before end of march and apply for H1B to get a 3-Year H1B. You will need to restart your PERM and go through the whole process with your new employer ASAP.

I guess Wacom advertises their tablets more vigorously than Genius? Who knows... have you compared Genius and Wacom side by side and discovered that Genius is far superior? My spouse and I are currently on H1-B and we applied for EAD and I-485 with my spouse as the primary applicant through his company.
Do I have to wait for 180 days before I change employers and start using the EAD (since I am the secondary applicant)? Or can I use my EAD as soon as I get it?

Currently my wife is on H4
I'm planning to file H1 for my wife (through another employer on April 1st, 2009). Regardless of the situation (H1B Cap lottery process or general process) if my wife's H1B petition is accepted, processed and approved (generally betwen April 15th 2009 and May 31st 2009), she will get work permit (with start date of Oct 1st, 2009) by May or mid June, 2009.
My company is also planning to file for my H1 Extension (along with H4 Extension) in April (cannot be filed it seems due to other cases) So, in this scenario if my H1 extension (along with my wife's H4 extension) is filed after April 1st 2009, then we will have an overlap situation (as USCIS will be receiving two petitions (one for H1 and one for H4) for my wife) in the same timeframe. How will USCIS deal with these scenarios?
As long as her H4 is approved before her H1 (if she gets through lottery and approval process), there won't be a problem (as H1 will be replacing her H4 to my understanding).
But if her H4 is approved after her H1B approval, then there is a risk that her H1B will be cancelled because of H4 approval.
Please let me know solution to this problem. Thanks in Advance
