Hi,
Can anyone share the experience of H1 Visa stamping in Hyderabad. As per their web site they need quite a lot of documentation. Not sure if such doecumentation is required for visa revalidation (same category - H1) as well.

If the petition is approved under Consular Processing then they need to leave the country. Other wise no. The reason for Consular Processing would be not maintaining the status continuously.
If you get I94 along with the approved H1B then you are fine. If not, you need to leave the country and get it stamped. Your other friends might have not got I94 along with their approved I94

Today I will be giving a presentation on immigration law along with my colleague, V. Thomas Langford, to the Air Force JAG serving at Travis Air Force Base in Fairfield, California. The Air Force JAG Corps are lawyers who provide legal advice to those serving in the Air Force.
Our training today will focus on the basics of immigration law. We will be covering family-based immigration law and outlining the procedures involved in petitioning for a family member to immigrate to the United States. We will also be talking about the Violence Against Women Act ("VAWA") and how an individual may self-petition for immigration status if he or she has been the victim of abuse or mental cruelty. Finally, we will discuss the naturalization laws as they apply to those serving in the military at a time of a conflict.
It seems that I always learn something while preparing for a presentation. While preparing for this one, I learned that staff from USCIS in Sacramento go to Travis Air Force Base twice a month to interview applicants for naturalization and administer the oath of citizenship on the same day. Kudos to USCIS for taking the time to do this. I think u did not submitted your 485 application. You can only apply for EAD once u submit your 485 application. There are three stages of GC...Labor, 140 and 485...Once u have approved labor.. you need apply for 140 when your priority date is not current...When your priority date is current then you can apply for 140 and 485 together. Once you apply for 485 you can get EAD.
Only exception when you are on L2 Visa.

Hello everybody,
First of all I must appologize because I mentioned this in the forum before but that was a different question that I asked.
My wife's Labor lists a 4 year degree with a BS in Mechanical Engineering as a requirement.
We filed I-140 with her old H1B evaluation which says she has a 4 year degree in Civil Engineering (stupid me :mad: ).
I found another evaluator who looked closely and gave us an evaluation for BS in Mechanical Engineering because her degree is way closer to the Mechanical than it is to the Civil Eng.
Will USCIS reject this I-140 on the spot based on the fact that she doesn't meet the requirements or issue an RFE ? If they issue an RFE and we send the Mechanical Eng. evaluation, will the fact that we filed first with the Civil Eng evaluation cause any problems ? Are we assuming the worst and is not such a big deal ??
She worked on H1B for 7 years as a Mech Eng and this is NOT a labour substitution.

MSNBC had a news piece on surprise illegal immigrants and looks like they are from India. I was surprised at a shocking 125,000 people have over stayed their visas and have become Illegal. I was worried if such news articles will reflect on our integrity and our image as knowledge workers.

For I-140 USCIS does not update the online status properly. For both of my EB3 and EB2 I-140s still the case status says they received the application and processing!
Wait for the document that they sent.

I HAVE H1 APPROVED TILL 04/10 BUT I ENTERED USA USING AP THIS YEAR SO MY UNDERSTANDING IS THAT I AM ON EAD NOW WITH SPONSORING EMPLOYER. I AM ASLO DOING PARTIME JOB IN OTHER FIELD ON EAD SINCE 01/08. NOW IF I GET FULL TIME JOB WITH OTHER EMPLOYER (other field)AND IF I WORK LESS HOURS (means I get under pay than showed in labor) WITH SPONSORING EMPLOYER, WILL I BE IN TROUBLE? Hi I am on H4,
Yesterday my h1b was approved ( cap h1b)
I got an offer from another company , ready to file my h1b ( non -cap) asap.
My question-If i apply for h1b transfer to non-cap without working for cap company in 7-10 days and later If I want to join a cap company,will I have to go through the lottery again -basically will i be subject to cap.
2.what is the proper process for transfer to occur.
3. I do not want to inform cap company.I have the receipt number.Is it sufficient to apply for transfer.

Go to nearby embassy and inform about your situation. Make sure to keep all the documents and all also duplicate copy of your visa. Hopefully everything will be fine.
