This will be a new H1 application since you never used the original one. You will need to go to the US Consulate with the new approved H1 document and they will ask you why u forsook the first one....

Hello,
My labour got approved but we still have to file for I-140. My h1b is going to expire on May 2007.
Can I get H1b extension based on Labour approval? If not, is it necessary to file I-140 soon.

Think about it , Is this really something you should be panicked about ?
I donot have my middle name mentioned in H1 anywhere although i filled my application with correct middle name. Its very common to not have midlle name mentioned by USCIS in application.
I have a spelling errors in last name in visa, no problems ever.
There are ways other than "Middle Name" to figure out who you are based on your appliation. So donot worry too much about it.

I am a resident physician on h1b visa which is expiring on 6-30-2010 . I am in process of applying for H1B extension for my fellowship. My wife is on H4 visa (expiring in 3-20-2013 since she got 5 yr multiple visa). Recently she visited Kuwait and on her re-entry she was given entry (on her I94) up to 3-15-2013 (up to 5 days prior to her visa expiration). Will she also need extension in this case along with my extension or can she stay in US till 2013 with out extension Thanks.

As long as they have valid visa, there should not be any problem entering after short gap outside USA.
I guess IO can object if this happens very frequently but in that case they will warn first rather than taking other action.

Please note that an I-485 approval invalidates the H-1B visa.
I would travel to the US before Advanced Parole expiry to obtain the GC and return. I am not sure of any exceptions - please post the question in 'Ask a Lawyer' section ASAP.

Like they are taking away chance from American Citizen basketball players and if they are supressing the NBA player's wages etc etc.... :D:D
I guess we should send this to Lou Dobbs and Mr. Grassley too !! This is highly unfair - only American citizens should be allowed in NBA, MLB , NFL etc etc. :D
Just let them bring a resolution and next year half the teams would be empty.;)

Yes he can , but once 180 days of pending "I-485" are passed then you are free and protected by AC21.

did my first MS, got First OPT ...worked on OPT..didnt find a job..
went back did my second MS..got another OPT...and moved into non-quota H1 (research field at a hospital)
now plan to go back and get an MBA..
1.) will i get an OPT after my (fulltime) MBA??? (as i already have 2 OPT's)...is there a limit of OPTS?
2.) Since i was a non-quota H1..will i have to apply for the quota H1 when and come out of MBA...which is basically a lottery system now!!! (and if i dont hit the jackpot that will put me out of status immediately after )
any inputs are appretiated!!
