Hi all,
I got my first H1B after my MS in Nov 2002 to Oct 2005. I have renewed my H1B for the next 3 year period (Nov 2005 to Oct 2008) and I have the necessary forms from the USCIS. Now I need to get my passport restamped. I am considering Tijuana, Mexico as I have a friend in San Diego that I want to see. However, my I94 form in my passport says it expires in Nov 2005. Now my question is:
Can I go to Mexico for a restamp? What is the procedure/risk involved?

I did my 7 th year visa transfer this year and again it took more than 2 months then nothing happened later I went for premium processing because my wife's H4 stamping date was coming closure. I guess usually it takes 2-3 months for transfering visa. Mine was Nebraska Service center. Again this year I am going for 8th year extension. Good luck for your visa transfer. Just relax and wait for USCIS reply on ur application.

I am almost in the same situation. My PD will hopefully be current in next bulletin and I've decided its worth to wait for couple of more months and not deal with any complications that may arise due to job change.

Hello all,
First some background:
I purchased a house this September and my apartment lease expires end of Sept. So I am basically living at both places and moving slowly. Anyway my USPS mail forwarding starts from 9/21.
As far as immigration and change of address goes, based on my lawyers advise...I filled out the online AR-11 change of address and also updated address change for my 485/ap/ead ( I am a july 2nd candidate) pending cases as well. However, after downloading the pdf version of the AR-11 I realized I misspell "Lane" to "Land." Don't know if this is a huge problem. Anyway can I re-file the AR-11 and change of address for all the pending petitions again for myself and my spouse? Does anyone have any thoughts or could share their experience? I read somewhere its also a good idea to update address with local office by getting info pass appointment? Any comments/ thoughts?
Also, in the AR-11 form I didn't provide email address, is that a big deal?

My sister in India may be getting married to a US citizen..she would like to apply for a tourist visa first so she can come stay in the US and spend some time with him before her marriage.
If she applies for a tourist visa, stays in the US for a month or so and then later they apply together for a fiance/K3 visa, are there going to be problems for the K3 visa application considering that she had just applied for a tourist visa before? Is it better to not apply for the tourist visa in this case? Thanks...

Depending on the above answer the process will be different.
I am planning to go to Canada because my PR will be ready soon and I have to land to get my cards. I am not planning to stay there. Unfortunately I was born in one of those five countries which I can not go out and in with H1. With this US immigration Retro. I really don't like to lose my Canadian profile.
I am looking for find a way going around this issue and make sure I can come back to us without any problem.

Hi,
My GC is still a far away thing for me. But I want to know this to prepare potential interview questions.
After getting a Green Card, as far as I know, if you live outside of U.S. longer than 6 months, you lose your Green Card.
Does that also apply if you are dispatched by your company (supposedly big U.S. corporation) to a overseas office for a couple years?

I usually spend some time every day at my San Francisco Bay Area immigration law office making inquires on pending cases. It is a frustrating process because I rarely receive answers and when I do, they usually are not helpful.
United States Citizenship and Immigration Services ("USCIS") has recently released guidance on how to make inquiries at their Service Centers (http://www.californiaimmigrationlawyerblog.com/USCIS%20update.pdf). They provide a three step process. The first step is to call their National Customer Service Center at 1-800-375-5283. If the issue is not resolved in 30 days, you proceed on to the next step which is to email the USCIS Service Center where your case is pending. The email addresses are:

My EAD and AP application got rejected because of missing signature on the form.Now i am planning to file on my own with out the help of attorney as he is charging me too much for refile.
So needed help in drafting the letter addressing the situation.Above all i didn't receive my application back and USCIS personnel told me that i can refile as a fresh application if i don't receive in 30days.And i am already completed the 30days.I do have the rejected application LIN number and my 485 receipt.
Please advice me what to do i want to avoid attorney.

Hi,
to stay away from india while on AOS, you need AP.
to maintain AOS, one needs to keep renewing AP.
So when you apply/renew AP candidate needs to be here...
So your daughter will apply for AP, get it , travel... come back 6 months prior to AP expiry, go to india and study and you will send AP by mail ...
she will come here every 4-6 months prior to AP expiry and renew and go back.
You need to give a sound reason in port of entry why you are staying away for long durations..!

I currently have approved EAD, I-140 and waiting for a Visa number to become available. My receipt date for I-485 was July 2nd 2007 and my notice date was September 27th. My employer is closing the IT department in March. Though it has been 180 days since my receipt date, it's not 180 days since my notice date. Will my I-485 processing be impacted when a Visa number becomes available? Also, will it be Ok if I'm out of a job for a short time while I'm looking for my next job? I sincerely appreciate the help and guidance in this matter.

If you are planning to use EAD no problem, but if you are planning to use AC21 with H1B then you need to maintain valid status as specified in your H1B. i.e., if you can mainting the salary specified in your offer letter and if that matches your W2 for the year, then you are ok.
These are my thoughts.

I called USCIS to know the status of my I765 and I131 and came to know it got rejected because of sign missing on the form as i had filed my 485 with my EAD and AP i got my 485 receipt month back.
And USCIS said they have mailed my returned application on 13th aug but i have not received it yet.I called USCIS and they said that i can refile it again after 30days if i don't receive my package. Can i file on my own i do have the LIN number for rejected application.Can i file online

I am about to switch to a new employer using AC21 and would work on EAD. I still have more than 2 years on my current H1B (i.e. I'm on 4th year right now).
Can I re-use my remaining H1B in case I need to in future? Because in case my I-485 gets a denial (which shouldn't be the case) I would be out of status!
My case:
sub-labor, 140 approved, I-485 pending for more than 1 year now.

I'm working for Company A and this is my 7th year on H1-B.
I got three years extension last year which is good until Aug'2012 through companyA.(Based on approved I-140 from my previous employer).
My previous employer withdrew my I-140 petition but luckly after getting my 3 year extension with Company A.

I got a very good offer from Company B but I didnt want to take chances with USCIS,so I've told them that I would join only after approval.
CompanyB applied for my H1-B peition asking for 3 year of extension based on I-140 approval.
I was told today that my CompanyB H1-B petition has been denied because of I-140 withdrawal from my previous employer.we didnt know about this because the online case status for I-140 was still showing as approved.
Question
1)Since I've a valid visa until 2012 with Company A. Can company B reappeal the decision asking for H1-B transfer only until 2012.

I am working for a company A with whome I have gone ahead and resigned with them i also filed my GC and 485 is still pending with them and also have EAD through them, recently i got offer from Company B which i accepted and they have gone ahead and filed my H1 Tranfer but recently i got one more offer from Company C which is much better.
What should be done in this scenario,should i again file for H1 Transfer through Company C or will it mess up my case even more
